1.    Personal Information We Collect or Obtain

We collect or obtain several types of personal information from and about consumers, including:

• Contact information, including name, mailing address, e-mail address, and telephone number
• Home address (when you provide it in using our home value estimator)
• Log-in information, including email address and password, or Google/Facebook credentials if you complete a single-sign-on using one of these platforms
• Location information (when you provide it in order to search for properties or when you consent by activating location services on your device) 
• Personal information you voluntarily include in questions, comments, or testimonials you enter in the free-form fields or chatbot windows on our website
• Contact information, including name and email address, for any friends to whom you forward listings through our website
• Job application information, including resume and licensing information
• Information regarding the device through which you access our website and contact us, including IP address
• Device/browser information, usage data, and other automatically-collected information as described below under “Cookies and Other Tracking.”

We collect or obtain the information described above from the following sources:

• You directly, based upon information you provide when you correspond with us via email, phone, or in-person; create an account, sign in, or subscribe on our website; use our home value estimator on our website; or submit questions, comments, or testimonials on our website
• Automatically through cookies, pixel tags/web beacons, or other tracking technologies as you use our website

Please be aware that home sales and purchases may be a matter of public record, and your name and address, the price you paid, your property taxes, and other information may be available from public sites regardless of the brokerage(s), if any, who assist in the transaction.

 

2.    Why We Collect, and How We Use, Personal Information

We collect and use the personal information described above for a variety of purposes:

• To provide you with effective real-estate-related services, knowledge, and guidance
• To facilitate your use of our website to search for properties and save listings of interest to you
• To keep in contact with you about our services and your use of them
• To provide you with updates regarding listings of interest to you
• To obtain feedback from you regarding our services
• To assist you in estimating the approximate value of your current home
• To help you obtain directions to properties of interest to you
• To allow you to save listings and unlock exclusive features such as property updates
• To allow you to share listings with your friends and others
• To conduct marketing outreach and retargeting to identify and provide you with information about other services you may be interested in
• To improve your experiences on our website, including personalizing our content in some instances
• To enable you to apply for employment with us
• For the purposes described below under “Cookies and Other Tracking”
• For the purposes described below under “Sharing and Disclosure of Personal Information”

3.    Cookies and Other Tracking

When you use our website, we collect information from you by automatic means, including cookies (small text or electronic files, some of which may be placed on your device or browser) and pixel tags (small images embedded in our website or in ads).  Cookies and pixel tags allow us to recognize and remember things about users of the website, such as their preferences, location, and saved searches; perform analytics, such as counting the number of users who have visited or used the website, determining how they got here, tracking their activity (including “clicks”) on the website, and gauging their interests; measure website performance; gather technical information about users’ devices, browsers, operating systems, IP addresses, etc.; assess and enhance our website’s performance, such as simplifying the log-in process; help protect our website against certain attacks; and assist with marketing.  The cookies used on our website may also identify other devices you use to visit our website, which helps us to ensure that our site functions correctly for any device you may be using.  Cookies do not give us access to your computer or device.

Cookies can also be managed, deleted, or modified through your internet/browser settings.  Please note that if you choose to reject cookies, you may be unable to fully utilize all of our websites' features and information.  Finally, please note that our website does not respond to “Do Not Track” signals or similar requests from browsers.

 

4.    Sharing and Disclosure of Personal Information

In the course of providing our services to you, we may share or disclose personal information with outside parties.  Specifically, the information we collect or obtain about you when you use our website or services (see “Personal Information We Collect or Obtain” above) may be shared with third-party vendors, so that we are better able to provide our services, including:

• Union Street Media, which created and maintains our website and may provide digital marketing services for us
• Third-party CRMs, which are automated Customer Relationship Management (CRM) platform that helps clients manage and engage more effectively with their clients and leads
• Fluency, which is a digital advertising operating system that helps us manage client marketing

In addition, information on your usage of our website is provided to third-party vendors including Google, Facebook, Microsoft, Amazon, Basis, Benchmetrics, Bandwidth, and ClickCease for marketing, analytics, and fraud prevention purposes.  

We do not sell (as defined in applicable privacy laws) your personal information for monetary or other consideration under any circumstances, nor do we use or share your personal information for targeted or cross-context behavioral advertising (as defined under applicable privacy laws) based upon your activities over time and across nonaffiliated websites or online services/applications, or for profiling in furtherance of decisions that produce legal or similarly significant effects on you (as defined under applicable privacy laws).
Finally, we may also disclose information about you if necessary to comply with applicable laws and regulations; to respond to any legal process or other lawful request for information we receive; to protect vital interests of you or another natural person; to detect, prevent, and investigate fraud, abuse, or other illegal activity; to defend our legal interests where necessary for our legitimate interests or the legitimate interests of others; or to otherwise protect our rights.  In addition, we may transfer personal information we have about you in the event we sell or transfer some or all of our business or assets.

 

5.    Links and Embedded Content

Our website may contain linked or embedded content from other websites or services that are outside our control and are not covered by this Privacy Notice.  If you access those links or content, the operators of those websites or services may collect information from you that will be used by them for their own respective purposes and in accordance with their own respective privacy policies, which may differ from ours.  We have no control over how other websites or services you elect to visit collect, use, or share your data.

 

6.    Advertisements on Our Website

 

Our website may contain advertisements from third-party manufacturers, as well as blogs sponsored by third-party manufacturers, that may be of interest to you.  Clicking on advertisements or on links in the blogs will take you to the manufacturers’ websites, which are outside our control and not covered by this Privacy Notice.  The manufacturers operating those sites may collect personal information from you that will be used by them for their own respective purposes and in accordance with their own respective privacy policies.  We encourage you to review these privacy policies, as they may differ from ours.

 

7.    Retention of Personal Information

 

We retain personal information for as long as reasonably necessary to achieve the purposes listed under “Why We Collect, and How We Use, Personal Information” section above, to provide customer service, to perform any other necessary tasks regarding our services, or to satisfy our legal obligations.  After that period, and to the extent permitted by applicable law, we may delete, anonymize, de-identify, or dispose of your information.

 

8.    Notice Regarding Children’s Privacy

 

We do not knowingly or intentionally request, collect, use, or share personal information from children under 13 years of age.  If we discover or are notified that this has occurred, we will immediately delete the information from our servers and instruct any third parties with whom we have shared the information to do so as well.

 

9.    Your Rights Concerning Personal Information

In General.  To learn about or access what personal information we have about you, and to update, correct, or delete that information, please contact us as indicated in the “How To Contact Us” section below.  Please note that under certain circumstances we may not be able to honor requests to delete certain information.

Regardless of where you reside, we will consider all requests you make regarding your information and will respond within any time period required by applicable law.  Please note, however, that certain information may be exempt from such requests, such as if we need to keep the information to comply with our own legal obligations or to establish, exercise, or defend legal claims.  Your rights and our response obligations also may vary based on your state or country of residency.  Please note that you may be located in a jurisdiction where we are not obligated, or are unable, to fulfill a request.  In such a case, your request may not be fulfilled.

We also reserve the right to verify your identity before responding to a request, which may include, at a minimum, depending on the sensitivity of the information you are requesting and the type of request you are making, verifying your name, email address, phone number, or other information unique to you (e.g., a password).

• To delete certain personal information
• To correct inaccuracies in your personal information, taking into account the nature of the information and our purpose for processing it
• To obtain a copy of your personal information in a portable and, to the extent technically feasible, readily-usable format, under certain circumstances
• To opt out of any processing of your personal information by us for targeted advertising purposes (as defined in applicable privacy laws), to the extent applicable
• To opt out of any sale of your personal information by us (as defined in applicable privacy laws), to the extent applicable
• To opt out of any processing of you personal information by us for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects on you (as defined in applicable privacy laws), to the extent applicable
• To not be discriminated or retaliated against, or have adverse action taken against you, for making requests about your information or exercising other rights concerning your information

Additionally, if you are a Delaware resident, you may also obtain a list of categories of third parties to which we have disclosed your personal information.  If you are an Oregon resident, you may also obtain a list of the categories of your personal information we have processed and specific third parties to which we have disclosed personal information.

Nevada Residents.  If you are a Nevada resident, you have the right to request that we not sell your “covered information” (as defined under Nevada law) to any person, by contacting us at the designated email address provided in the "How To Contact Us" section below.  Any such request made to us must be verifiable before we have any obligation to fulfill it.

 

10. Exercising Your Data Rights

 

To exercise any of your applicable data rights as outlined above, or to withdraw any consent you have provided, please contact us via any of the means provided in the “How To Contact Us” section below.  Any request must include sufficient detail so that we can understand, evaluate, and respond to the request.  Alternatively, you may exercise your data rights through our website by clicking here.

Any of the above data rights requests made to us must be verifiable before we have any obligation to fulfill them.  A request must provide details sufficient to enable us to reasonably verify that you are the person about whom the requested information pertains.  This verification process may include, depending on the sensitivity of the information you are requesting and the type of request you are making, verifying your name, email address, phone number, or other information unique to you (e.g., a password).

Depending on where you reside, applicable law in your state may also allow you to designate an authorized agent to submit data rights requests on your behalf.  In order for an authorized agent to be verified, the agent must provide us with signed written permission from you or a power of attorney.  We may also follow up with you to verify your identity and permission before processing the authorized agent’s request.

Finally, under applicable law in your state of residence, you may also be entitled to appeal any decision we make with respect to your data rights request.  To make an appeal, please contact us – within thirty (30) days of our decision – via any of the means provided in the “How To Contact Us” section below.

 

11.    Additional Notice for California Residents

This section provides additional disclosures about our collection and use of personal information as that term is defined in the California Consumer Privacy Act of 2018 (“CCPA”). 

In the past twelve months, we have collected the categories of personal information listed in the “Personal Information We Collect or Obtain “ and “Cookies and Other Tracking” sections above, and in that same period we have disclosed those categories of information to the categories of third parties listed in the “Sharing and Disclosure of Personal Information” section above.

We do not sell (as that term is defined in CCPA), and have not sold, personal information of California residents, including minors under 16 years of age.

We do not collect, use, or disclose “sensitive personal information” (as that term is defined in CCPA) except as necessary to provide our services to you. 

We do not share (as that term is defined in CCPA) personal information (including for minors under 16 years of age) with third parties for cross-context behavioral advertising.

Finally, California’s “Shine The Light” law provides California residents the right under certain circumstances to request a disclosure regarding the sharing of certain categories of personal information (as that term defined in the law) with third parties for their direct marketing purposes.  We do not share your personal information with third parties for their direct marketing purposes within the meaning of that law.  

12.    Notice for European Economic Area and United Kingdom Residents

This section applies only to residents of the European Economic Area (“EEA”) or the United Kingdom (“UK”).  For purposes of the EU General Data Protection Regulation (“GDPR”) and the UK GDPR, Union Street Media is a data controller as defined in these laws with regard to any data we collect from and about you that can be used to personally identify you (“personal data”).

If you are resident of the EEA or the UK, GDPR allows us to process your “personal data” only if we have a “legal basis” to do so.  Our legal bases for processing your personal data are as follows:

 

• Where you have given your consent (in such cases, you may withdraw your consent at any time as described below under “Your Rights with Respect to Your Information”)
• To enter into contracts/transactions with you and perform our obligations pursuant to those contracts/transactions with you
• For our legitimate business interests or the legitimate interests of our clients (see the purposes listed at the beginning of this “Why We Collect, and How We Use, Your Information” section)

13.    Protection of Your Information

We follow generally accepted industry standards and maintain reasonable safeguards in order to protect your personal information, both during transmission and after receipt, from accidental or unauthorized access, use, disclosure, alteration, destruction, or loss.  These safeguards include technological measures such as [data encryption in transit and at rest, multi-factor authentication, and role-based access, network security measures such as firewalls and network security groups as well as threat detection & intrusion prevention systems]; administrative measures such as [follow OWASP Top 10 best practices as well as perform regular audits and risk assessments]; and physical measures such as [locked doors/drawers and access restrictions].  However, as no method of transmission over the Internet or method of electronic storage is 100% secure, we cannot guarantee absolute security.
